While we disagree with the DOJ and ATF regarding Stabilizing pistol braces we must comply with all regulations set forth in order to operate legally.
Due to the recent ATF Final Ruling being published in the federal registrar and per ATF guidelines all items previously classified as "Pistols" that have a stabilizing brace will have the braces removed and discarded prior to shipment so we can ship them as pistols and they can be transferred as pistols. We will be updating our website over the coming weeks to remove all pictures of firearms with braces, blades, or anything that the ATF would consider to be "Able to be shouldered", per this classification, buffer tubes necessary for the operation of the firearm are allowed. Per ATF training dialog we can simply remove the brace leaving the buffer tube and continue to sell these as pistols. Please note even though braces or blades may still be pictured they are not included with the purchase of these firearms. If you have a question about a specific sku and what all comes with it please use contact us on our website and ask, we will happily help. We are actively monitoring this situation and will react accordingly should we get different direction from the ATF or our Attorney's.
Questions:
Q: How do I know if my local FFL will transfer this item?
A: As all firearms previously sold with a pistol brace will now be sold with just the buffer tube these are still classified as pistols and able to be transferred per our understanding and guidance on this law. It is the buyers responsibility to contact your receiving dealer and make sure they will transfer this firearm. Any items returned to us will be subject to a 10% restocking fee and/or associated shipping costs.
Q: Will you ship the removed brace to a separate address?
A: No, As this can be considered constructive possession or a constructive sale all stabilizing braces will be removed and will not be shipped to the customer at any address, these items are no longer considered to be a part of this sale.
Q: Will you offer financial compensation for the removal of stabilizing braces?
A: No, items are sold with the buffer tube as is needed for function and without the stabilizing brace, no financial compensation will be given for the removal of a brace or blade to maintain the classification of pistol.
Q: Will you still offer braces, or blades for sale on your website?
A: Yes we will still offer braces or blades on our website as they are not regulated by the ATF, please do not purchase them with a firearm to avoid any confusion.
Q: If I am required under the Final Rule as published in the federal register to register your firearm under the NFA will you help me complete my ATF form1?
A: No, we are not allowed or involved in the form1 process, please visit ATF.gov for instructions on how to complete this process and/or any engravings that may be required. You may do form1's thru SilencerShop.com's Form1 service however any persons needing fingerprints in our physical shop will be subject to a Kiosk fee and we are unable to help further in this process.
Q: I already purchased a firearm from you that was previously sold as a pistol, what are my options.
A: Please visit ATF.gov or ask your local ATF field office for guidance regarding this firearm, options may include removing the stabilizing brace and/or registering the firearm under the NFA, but these options may or may not pertain to your situation. We do not offer further support and cannot take this item back.
